Implementation procedure [appeal to the Digital Ombudsman]

The person in charge of the proceedings is the Digital Defender, who appoints a Responsible Instructor to carry out the preliminary activities. Anyone may submit to the Digital Defender reports on alleged violations of the CAD and any other rules on digitization and innovation of public administration by the subjects referred to in Article 2, paragraph 2 of the CAD.

The report must be submitted by the interested party electronically by filling out the form on the AgID website by logging in via SPID or CIE in the appropriate area on the AgID website.

The report must contain the identifying data of the reporter and the exact indication of the reported, as well as the express declaration of assumption of responsibility regarding the information provided and the documents, if any, produced issued pursuant to Presidential Decree 445/2000. These data and declaration constitute essential elements of the report in the absence of which the Digital Defender declares the inadmissibility of the report itself.

No communication from AgID will follow unless proceedings are initiated. The report will be deemed to be finalized with a dismissal if the proceedings are not initiated within the 90-day period after receipt of the report.

In the event that the report results in the initiation of proceedings, the data of the reporter will be processed for the management of the report, including the communication of the report to the reporter. Any specific and justified requirements for anonymity must be declared at the time of the report.

The Contestation and Report may be deemed inadmissible for the following reasons:

a. Incompetence of the Digital Defender, even taking into account the institutional competencies of the Agency;

b. excessive generality or vagueness;

c. lack of information elements;

d. Identity of the dispute or report with another for which an order has already been issued;

e. plurality of payers indicated in the same report;

In the cases referred to in Paragraph 1, the Digital Defender shall proceed to order that the Contestation or Report be dismissed.

INITIATION OF PROCEEDINGS The Person in charge shall communicate the initiation of the proceedings to the disbursing party except in cases where the report is declared inadmissible pursuant to Article 6 of these Regulations. The notice of initiation of the procedure shall contain: a) an indication of the Person in charge of the procedure; b) the subject of the assessment; c) an indication that the procedure will be concluded within 120 days, except for any suspensions indicated in these Regulations.

INSTRUCTORY The inquiry phase is concluded within 90 days of the Digital Defender’s receipt of the report or dispute complete with all documentation. In the course of the preliminary investigation, the Digital Defender may request information or documents from the reporter and/or the disbursing party, with an indication of a peremptory deadline of 15 days for feedback, also communicating that in case of no response it will proceed with the only elements available. Where necessary in the course of the investigation, the person in charge of the procedure may request information[1]or opinions from other Offices/Services of the Agency.
